How Sessions Typically Work
The mediator helps the parties focus on the children's actual schedule and needs rather than fixed positions. Proposals are tested against school calendars and real logistics, and the resulting plan is written down for review by counsel.
Florida uses time-sharing rather than custody, and every dissolution with minor children requires a parenting plan — the schedule, decision-making, and communication terms the parties work out here become its substance.
Since July 1, 2023, Florida law presumes equal time-sharing is in the child's best interest. The presumption can be rebutted; whether it applies or is overcome in a particular case is a question for counsel. In mediation, the plan still has to fit the child's school, the parents' work, and the family's actual logistics.

When this process is not a fit
Mediation is voluntary and only works when both people can speak for themselves and the conversation can stay balanced. It is usually the wrong tool when there is an injunction or a history of domestic violence that would compromise the process, when assets appear to be hidden, or when a party needs emergency court relief. Counsel remains counsel. Agreed terms are written down for review and drafting by each party’s own attorney. The mediator does not give legal advice, interpret a governing order, or file anything with the court.
